Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Trial Beacon website and pre-screening service (the “Service”) operated by Trial Beacon (“Trial Beacon,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Trial Beacon is a free, public, informational tool that helps users identify oncology clinical trials for which they may be eligible. The Service may, at the user’s option, retrieve health information from a third-party patient portal directly into the user’s browser in order to compute potential matches locally. The Service is not health care, is not a substitute for professional medical advice, diagnosis, or treatment, and does not establish any physician-patient or other treatment relationship.

2. Eligibility and Account

The Service is intended for users who are at least 18 years old (or the age of majority in their jurisdiction). The Service does not require, and does not offer, user registration or accounts. You are responsible for any device, browser, network connection, and patient-portal credentials you use to access the Service.

3. Not Medical Advice; No Eligibility Determination

Information presented by the Service — including any list of potentially matching trials, plain-language summaries, structured eligibility rules, and the “met / not met / discuss” buckets — is informational only. The Service does not determine whether you are eligible for any clinical trial. Eligibility for a clinical trial is determined exclusively by the qualified clinical investigator(s) responsible for that trial. You should always consult your treating physician or other qualified health care provider about any clinical trial before taking any action.

You acknowledge that information about clinical trials changes frequently, that the Service relies on third-party data sources that may contain errors or omissions, and that the Service may not reflect the most current information at any given time.

4. Acceptable Use

You agree not to:

  • use the Service in any manner that violates applicable law or regulation;
  • use the Service to make a clinical, treatment, or eligibility decision without the involvement of a qualified health care provider;
  • use the Service on behalf of another person without that person’s authorization;
  • interfere with, disrupt, probe, or test the security of the Service except as expressly permitted under our responsible disclosure policy (see /security);
  • scrape, crawl, harvest, or otherwise systematically extract data from the Service except in compliance with robots.txt and any rate limits we communicate;
  • reverse engineer, decompile, or attempt to derive the source code of any non-public component of the Service, except to the extent such activity is expressly permitted by applicable law; or
  • use the Service to transmit malware, conduct phishing, or misrepresent your identity or affiliation.

5. Third-Party Services and Data

The Service interoperates with third-party services and data sources, including ClinicalTrials.gov and Epic / MyChart. Your use of those services is governed by their own terms and privacy notices, and Trial Beacon is not responsible for their content, availability, accuracy, or practices. The Service may also link to external sites that are independently operated; we do not endorse and are not responsible for those sites.

6. Intellectual Property

The Service, including its text, graphics, logos, design, software, and arrangement, is owned by Trial Beacon or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial, informational use. We reserve all rights not expressly granted.

The “Trial Beacon” name and logo are trademarks of Trial Beacon. You may not use them without our prior written consent. Clinical trial information presented through the Service is sourced from public registries (such as ClinicalTrials.gov) and remains subject to those registries’ terms.

7. Feedback

If you submit suggestions, feedback, or other ideas to us, you grant Trial Beacon a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and incorporate that feedback for any purpose, without obligation to you.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranty of any kind.

To the fullest extent permitted by law, Trial Beacon disclaims all warranties, express, implied, statutory, or otherwise, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade. Without limiting the foregoing, Trial Beacon does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any information presented through the Service will be accurate, current, or complete.

Some jurisdictions do not allow the disclaimer of certain warranties, so some of the above disclaimers may not apply to you.

9. Limitation of Liability

To the fullest extent permitted by law, Trial Beacon and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.

Trial Beacon’s aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars (US $100). The foregoing limitations apply whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Trial Beacon has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Trial Beacon and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (i) your use of the Service, (ii) your violation of these Terms, or (iii) your violation of any law or the rights of any third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including any violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 6 (Intellectual Property), 7 (Feedback), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law and Disputes), and 14 (Miscellaneous).

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You and Trial Beacon agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts. Nothing in this Section limits either party’s right to seek injunctive or equitable relief in any court of competent jurisdiction.

Any claim arising out of or relating to the Service must be filed within one year after the claim arose; otherwise it is permanently barred.

13. Changes to These Terms

We may modify these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be highlighted on the Service for a reasonable period before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Trial Beacon regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely. These Terms do not create any agency, partnership, joint-venture, or employment relationship.

Disclaimer. These Terms are a binding agreement between you and Trial Beacon. Nothing in these Terms is intended to be, and should not be construed as, legal or medical advice for your individual circumstances.
